A Good Faith Error on Elm Street
The original Nightmare is one of my favorite movies. There’s so much to love about it. My legal friends assure me that the setup doesn’t make sense, however: conducting a search on the right house when the wrong house is listed on the search warrant constitutes a good faith error on the part of the police, and the evidence would still be admissible. No need for vigilante justice. And one of the lovable things about the movie is its message that vigilante justice is suboptimal even if the guy really deserves it.
